Our desire is to delight our clients. One way is to make clear our understandings with each other. These are the terms of our agreement in regards to providing services to our clients.

Our website is our virtual store front. We will honor all promises, prices and claims made thereupon. Prices quoted on our website are subject to change without prior notice.

We take no responsibility for the content, availability or accuracy of any external sites we may link to. We do however accept that errors will be made from time to time on our own site, which we will work to rectify on our next update

Our portfolio contains work that the operators of Think Interaktive have worked on as sole contractors or sub-contractors for another agency. Think claims no rights of ownership or copyright of any site displayed in our portfolio. All sites a displayed for exhibiton purposes as a demonstration of our abilities and creativity.

IMPORTANT!! All work will be governed by the scope outlined in the quotation documentation, except where the client has requested modifications. Quotation documents are named TI_(client number)_(job type)_quote.doc eg. TI_000_webdevelopment_quote.doc. Where 000 refers to the client number and webdevelopment the job type.

modifications Modifications to the project must be by email notification. with the most recent email notice superceding all those that were written before. Project modifications may attract our hourly rate

Payment of fees

Think requires a 50% deposit, prior to the start of every job. The project will be turned over to the client upon completion.

The client is obligated to pay all outstanding fees to Think within five (5) business days of the projects delivery. In order for Think Interaktive to remain in business, payments must be made promptly. Delinquent bills will be assessed a 3% daily late penalty. If an amount remains delinquent 30 days after its due date, an additional 5% penalty will be added for each month of delinquency. Please pay on time.

Web Development

The content of the webpages will be supplied by the client and executed as agreed upon in the terms of service and development goals sections of the quotation. If the client desires additional development, beyond the scope originally agreed upon the client agrees to accept billing at Think Interaktive's hourly rate.

Web Application Development

We create our web apps using php. It's the clients responsibility to ensure that their web server can run php scripts. The application will be built to the specification of the "functionality" section of the "quotation documents". If the client desires additional development, beyond the scope originally agreed upon the client agrees to accept billing at Think Interaktive's hourly rate.

Web Maintenance

Web Maintenance refers to the updating of the content of a website. It does not include the adding of pages or sections or the modification of the website structure in any way. It involves updating links and making minor changes to a sentence or paragraph. It does not including removing nearly all the text from a page and replacing it with new text. It involves adding news and updating photogalleries. If the client or an agent other than Think Interaktive attempts updating the client's pages, time to repair webpages will be assessed at our hourly rate for web development.

Email Marketing

The client will provide Think Interaktive with there database of emails whom the emails will be sent to. Think Interaktive will not use this email database for any other purpose than to send the email communications of the said client who furnished the database. The client takes all responsibility of the legality of there email lists and will accept liability for any spam complaints as a result.

SEO (search engine optimisation)

Think Interaktive will implement techniques and strategies to properly optimise your page for spidering by search engines. We in know way gaurantee search engine positioning as this is based solely on the algorythms and rank assigned by the search engines.

E-ccomerce

The client is solely responsible for the furnishing of think with an eccomerce account to process credit cards requests.

flash & motion graphics

Think Interaktive will create flash and motion graphics to the clients specification.

Web Hosting

Think Gaurantees a 99% uptime to your website hosted on our servers. All hosting fees must be paid on time, Think reserves the right to suspend any account that is more than ten (10) days past due.

Assignment of Project

Think Interaktive reserves the right to assign subcontractors to any project to insure the right fit for the job as well as on-time completion.

Project Completion

If Think is unable to complete a project due to the tardiness of the client in providing think with the content, access or any other asset or device necessary to complete the project, or due to the clients unwillingness to provide feedback on progress achieved. Then Think reserves the right to nullify the agreement without refund of downpayment.

Legal Stuff

Think Interaktive does not warrant that the operation of the webpages will be uninterrupted or error-free. The entire risk as to the quality and performance of the webpages and website is with client. In no event will Think Interaktive be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these webpages or website, even if Think Interaktive has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Copyrights and Trademarks

The client represents to Think Interaktive and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Think Interaktive for inclusion in webpages are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Think Interaktive and its subcontractors from any claim or suit arising from the use of such elements furnished by the client.

Laws Affecting Electronic Commerce

From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. The client agrees that the client is solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend Think Interaktive and its subcontractors from any claim, suit, penalty, tax, or tariff arising from the client's exercise of Internet electronic commerce.

Sole Agreement

The agreement contained in this "Rules of engagement" constitutes the sole agreement between Think Interaktive and the client regarding our work relationships. All prices specified in the "quotation documents" will be honored for six (6) months after the the date thereupon. services after that time will require a new agreement.
